MarginMark terms of service
These terms are an agreement between you and Plainsman Software about your use of the MarginMark Chrome extension, the MarginMark account service, and this website (together, "MarginMark"). By installing MarginMark or creating an account, you agree to them. If you use MarginMark for a business, you agree on behalf of that business.
1. Who we are
MarginMark is made by Plainsman Software, a sole proprietorship registered in Missouri, USA. Our mailing address is 1200 Lake Saint Louis Blvd #1089, Lake Saint Louis, MO 63367.
2. The service
MarginMark is a browser extension that reads the TikTok Shop Seller Center pages you open and combines that information with the costs and files you provide, to estimate the profit on your products and creators. Some features need a free account, and some need a paid plan. We may add, change or remove features over time. If we remove a paid feature you rely on, you can cancel and ask for a prorated refund of the unused part of your current period.
You must be at least 18 years old and able to form a binding contract to use MarginMark.
3. Your account
- Give us an email address you control. We use it to verify your account, send sign-in codes and billing notices, and answer support requests.
- Keep your password private. You're responsible for activity in your account. Tell us right away at support@plainsmansoftware.com if you think someone else has access to it.
- One person per account. Don't share an account or create several accounts to get extra free trials.
4. Plans, trials and billing
- Free costs nothing and has the limits shown on our pricing page.
- Pro is $14.99 per month or $120 per year, in US dollars, plus any tax that applies.
- Free trial. New Pro customers get a 7-day free trial, once per person. You'll need a payment method to start it. If you don't cancel before the trial ends, your subscription begins and your payment method is charged on the date shown at checkout.
- Renewal. Paid plans renew automatically at the end of each monthly or yearly period, and we charge your payment method at the then-current price until you cancel.
- Cancel anytime from Manage billing in the extension. Canceling stops future renewals. You keep access until the end of the period you've paid for.
- Plan changes. If you switch plans, the checkout or billing screen shows any price difference before you confirm.
- Price changes. We'll email you at least 30 days before a price change applies to your subscription. If you don't want the new price, you can cancel before it takes effect.
- Payments are processed by Stripe. We don't receive or store your full card number.
- Failed payments. If a renewal payment fails, we'll ask you to update your payment method. If it isn't updated, your plan may return to Free.
5. Refunds
Cancel during the free trial and you won't be charged. Paid periods aren't refundable, except where the law requires a refund or as described in section 2. However, if you're charged and didn't use MarginMark during that period, email support@plainsmansoftware.com within 7 days of the charge and we'll refund it.
6. Acceptable use
Don't:
- use MarginMark to break the law or TikTok Shop's seller policies;
- use it on Seller Center accounts you aren't authorized to access;
- try to get around plan limits, payment or security controls;
- reverse engineer the service, except where the law allows it;
- overload, scrape or attack our servers;
- resell MarginMark without our written permission.
We may suspend accounts that do these things.
7. TikTok
MarginMark is not affiliated with, endorsed by, or sponsored by TikTok. TikTok and TikTok Shop are trademarks of their owners. TikTok can change Seller Center at any time, which may stop some MarginMark features from working until we update them. We'll work to restore them promptly, but we can't guarantee how TikTok's pages will behave.
8. Estimates, not advice
MarginMark's numbers are estimates. They depend on the prices Seller Center shows, the fees we can calculate or import, and the costs you enter. Check important numbers against your TikTok statements before you make pricing, inventory or creator decisions. MarginMark doesn't provide financial, tax, accounting or legal advice.
9. Your data
You keep ownership of the information you put into MarginMark. You give us permission to process it only to run and support the service for you. Our privacy policy explains what we collect, where it's stored and how to delete it.
10. Our software
MarginMark, its code and its design belong to Plainsman Software. We give you a personal, non-exclusive, non-transferable license to use MarginMark under these terms while your account is in good standing. If you send us feedback or ideas, we can use them without owing you anything.
11. Disclaimers
MarginMark is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that MarginMark will be error-free or uninterrupted, or that its estimates will match your actual results.
12. Limitation of liability
To the extent the law allows, Plainsman Software isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of MarginMark. Our total liability for any claim about MarginMark is limited to the greater of the amount you paid us in the 12 months before the claim, or $50. Some places don't allow these limits, so they may not all apply to you.
13. Ending the agreement
You can stop using MarginMark at any time, and you can delete your account from the account screen in the extension. We may suspend or close an account that breaks these terms. If we close your account without cause, we'll refund the unused part of any prepaid period. Sections 8, 10, 11, 12 and 15 continue after the agreement ends.
14. Changes to these terms
We may update these terms. If a change materially affects you, we'll email you or show a notice in MarginMark at least 14 days before it takes effect. Continuing to use MarginMark after that means you accept the new terms.
15. Governing law
These terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in St. Charles County, Missouri, and both parties consent to that venue. Either party may instead bring an individual claim in small claims court.
